Meal Subscription Contract
Section One:
The company supplies the meals according to the package selected by the subscriber; which are delivered once per day on the days designated for the package.
The subscriber gives the company authorization to select the daily menu and meals.
The two parties -company and subscriber- concur that the prices designated for each package are in Kuwaiti Dinars and are final, to be paid in full, electronically, prior to the commencement of the subscription.
Section Two- The Contract:
Terms and conditions stated in this contract apply from the moment of payment by the subscriber for any of the packages, by any method of payment. Payment from the subscriber to the company is deemed as an acceptance to be bound by the terms of this contract.
The company reserves the right to alter the terms and conditions of the contact without notifying the subscriber or attaining his/her approval.
Section Three- Subscription Credit and Suspension:
- The meal box is counted and deducted from the subscriber’s subscription credit(1) if it is delivered or due to be delivered within the upcoming 24 hours, and it is non-retractable.
- The maximum time period for suspension of the subscription is two weeks(2), and suspension needs to be requested before 72 hours from the intended suspension day.
- The maximum time period for delaying the beginning of the subscription is also two weeks, and is counted as a subscription suspension.
Section Four- Cancelation Policy:
- The company gives the subscriber the right to cancel the subscription within the first 3 days(3) from the beginning of the subscription. The subscriber receives a refund of the amount paid, after deducting: a fixed cancelation penalty of 10% of the subscription price, 1 KD bank transfer fee, and the cost of the meal boxes(4) delivered, or to be delivered the following day of the cancelation request.
- If the cancelation is requested by the subscriber before the beginning of the subscription, i.e. of the first delivery is not due to be delivered within the upcoming 24 hours, only the 10% fixed penalty and the 1 KD bank transfer fee is deducted.
- The subscriber is not eligible to any refund after 3 days of the commencement of the subscription.
Section Five- Changing the Subscription Type:
- The company gives the subscriber the right to request a change in the type of subscription, or its duration, or the number of meals in the subscription, with receiving due refund by the company, or paying the cost difference by the subscriber, only withing the first 3 days of the subscription.
- After this time-limit, only the changes stated below are possible, without any refund of the cost difference to the subscriber:
- Switching from Keto to Low Carb, or vice versa (in the case of switching from low carb to keto, the company reserves the right to request payment of the price difference).
- The subscriber can request an addition of an extra meal, or a salad, or a protein pack, after paying the addition cost. The subscriber can request to switch one of the meal type to another type, without paying a price difference (if the meal types have the same cost); for example changing the dinner into a salad, etc.
- The subscriber can request canceling a meal type and minimize the number of meals in the both, but is not eligible for any refund of the difference in cost if the request is after 3 days from the beginning of the subscription.
- The company is not required to implement the changes immediately after the subscriber’s request, and it reserves the right to take the time it requires before implementing the changes, which is usually one two working days, or any another number of days, depending on the circumstances.
Section Six- Suspension/freezing terms and conditions:
- 4 weeks subscriptions (max) : the subscriber can freeze up to 12 days during 24 days subscription
- 6 weeks subscriptions : the subscriber can freeze up to 18 days during 30 days subscription
- 12 weeks subscriptions: the subscriber can freeze up to 24 days during 72 days subscription
- Suspension / Freezing is not applicable for any subscription with duration less than 24 days
- All suspensions / freezings must be received 72 hours prior to the suspension/freezing commencement date.
Section Seven- Health Concerns:
- The company does not hold responsibility for any health complications or allergies or unfavorable symptoms that could arise from consuming the meals supplied by the company, under any circumstance. The subscriber is not entitled to any refunding (if 3 days have passed since starting) or any other form of compensation, should any negative health effects arise.
- The company is not obliged to fulfill the subscriber’s requests related to excluding a certain food item, or any other special alterations to the menu and the meals,be the reason a food-related sensitivity, a health-related requirement, or any other reason.
- The meals provided by the company are not designed for nor are they to be regarded as medical treatment. The company does not design nor individualize special therapeutic diets.
- In the case of health issues, it is solely the subscriber’s responsibility to ensure that the meals and the ingredients are not contraindicated with their health conditions.
- The service of nutritional & health consultations and instructions are to be regarded as supplementary services and are not an official part of the subscription or package. The company is not to be considered obliged to supply them.
Section Eight – Delivery:
- Delivery is only to residential areas. The company is not obliged to deliver to other places such as industrial areas, chalets, farms, etc.
- The subscriber shall specify one address to receive the deliveries.
- The company reserves the right to refuse allocating more than one fixed address for specific days of the week.
- In the case that the subscriber requests an address change, temporarily or permanently, the subscriber shall inform the team at least 2 days before, during the customer service’s working hours, and shall await active confirmation. The company reserves the right to refuse delivering to the new address if the change is requested on too short a notice (whether on the same day, or late the night before).
- In the case of giving the subscriber confirmation for address change, the company is obliged to deliver to the new address, and in the case it fails to deliver the meals, is required to compensate the subscriber with one additional day to the subscription.
- The company reserves the right to refuse allocating a fixed delivery time for delivery. Alternatively, the subscriber & the company can agree on having the delivery during an alternative delivery session (such as the morning session – before 12 pm-), depending the ability of the delivery team at that time.
- In the case that the company fails to deliver during the agreed-upon delivery session (whether the morning -until 12pm- or regular session -until 6pm-), on the agreed-upon day, the subscriber has the right to receive compensation by having one day to his/her subscription.
- In the case that the subscriber (or anyone on his behalf) fails to personally receive the box or answer the driver’s or staffs’ calls, the company reserves the right to specify another time to deliver, even if it’s the next day’s morning.
Section Nine- Penalties:
- In the case that the company fails to uphold its obligations, the subscriber has the right to terminate contract and receive refund for the subscription, whether partial or in full, depending on the circumstance.
- The company reserves the right to terminate the contact with the subscriber and refund him/her the reminder of the subscription value at anytime, for any reason it deems plausible, such as assaulting or insulting any of its staff, or any other undisclosed reason.
- The company reserves the right to refuse the subscription or renewal of subscription of any person, be it a previous subscriber, or someone who has never subscribed before.
Foot notes
(1) The credit is the number of boxes to be delivered in each subscription
(2) One subscription week in the regular subscriptions is counted as 6 delivery days.
(3) A day of subscription is the day for which the meals are intended.
(4) The cost of each box varies with each package. The cost of each box is calculated by dividing the total cost of the subscription by the number of credit days in the subscription.
Restrictions
KETO & LOW CARB MEAL PLANS
A minimum order of 2 meals per day are required to subscribe. 1 lunch and 1 dinner.
Breakfast, snacks and protein packs do not constitute a meal and 0 quantity is required to subscribe.
